A lawyer for Luigi Mangione, the man accused of fatally gunning down U.S. health insurance executive Brian Thompson in December, told a judge Friday that her client was illegally searched during his arrest and she would seek to exclude that evidence from his trial on state murder and terrorism charges.

The Supreme Court placed the emergency application in "abeyance," until the temporary reinstallment of Hampton Dellinger as the leader of the Office of Special Counsel expires next Wednesday.

A lower court temporarily reinstated Hampton Dellinger, head of the Office of Special Counsel, after he sued the administration this month for firing him.
